Right of withdrawal

Pursuant to Art. 5 DL 185/1999, if the customer is a consumer (i.e. a natural person who buys goods for purposes not related to his professional activity, or does not make the purchase by indicating in the order form to Il filarino di Rotino Lorenza a reference of VAT), has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without penalty, except as indicated in paragraph 3 below.

1. To exercise this right, the customer must send Il filarino di Rotino Lorenza a notice to that effect, within 10 working days from the date of receipt of the goods.
   Such notice must be sent by email to: info@ilfilarino.it sent STRICTLY within the next 48 hours.
   Once we receive the above notice of withdrawal, Il filarino di Rotino Lorenza will quickly notify the Customer instructions on how to return the goods, which must be received by Il filarino di Rotino Lorenza within 10 days of authorization.

3. However, the right of withdrawal is subject to the following conditions:

• the right applies to the purchased product in its entirety; it is not possible to exercise withdrawal only on part of the purchased product (eg: accessories, attachments, etc. …);
• the purchased goods must be undamaged and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment); to limit damage to the original package, we recommend, when possible, to put it in a second box.
  The affixing of labels or adhesive tapes directly on the original product packaging should be avoided in all cases;
• in the case of yarn, in skein or ball, the item must be returned completely intact.
  Partially used balls or skeins cannot be returned;
• In accordance with the law, the shipping costs related to the return of the goods shall be borne by the customer;
• shipping, until the goods are received by Il Filarino di Rotino Lorenza, is the complete responsibility of the customer;
• in case of damage to the property during transport, Il filarino di Rotino Lorenza will notify the customer of the incident (within 5 working days of receipt of the goods), to enable him to file a timely complaint against the carrier of his choice and obtain reimbursement of the value of the property (if insured); in this case, the product will be made available to the customer for its return, simultaneously canceling the request for withdrawal;

• Il Filarino di Rotino Lorenza is not liable in any way for damage or theft/loss of goods returned by uninsured shipments;
• upon its arrival at our store, the product will be examined for any damage or tampering not resulting from transportation. If the packaging and / or the original packaging are damaged, Il Filarino di Rotino Lorenza will deduct from the refund due a percentage, but no more than 10% of it, as a contribution to the costs of restoration.

4. Without prejudice to any repair costs for damages assessed to the original packaging, Il Filarino di Rotino Lorenza will refund the customer the full amount already paid, within 14 days of the return of the goods.

5. The right of withdrawal lapses totally, for lack of the essential condition of integrity of the good (packaging and / or its contents), in cases where Il Filarino di Rotino Lorenza ascertains:

• The lack of the original outer packaging and/or inner packaging;
• The absence of integral elements of the product.
• Damage to the product due to causes other than its transportation.

In case of forfeiture of the right of withdrawal, Il Filarino di Rotino Lorenza will return the purchased goods to the sender, charging the same shipping costs.
